Some parts of the VIVID Pill Counter and the VIVID Application or software are available only with a paid Subscription. You will be billed in advance on a recurring and periodic basis (such as daily, weekly, monthly, or annually), depending on the type of Subscription plan you select when purchasing the Subscription.
Your Subscription will automatically renew under the exact same conditions unless You cancel it, or Scientific Industries, Inc. cancels it.
You may cancel your Subscription renewal either through your Account settings page or by contacting Scientific Industries, Inc. You will not receive a refund for the fees you already paid for your current Subscription period, and you will be able to access the Service until the end of your current Subscription period. Scientific Industries, Inc. may cancel your Subscription at its discretion, including for non-payment.
You shall provide Scientific Industries, Inc. with accurate and complete billing information including full name, address, state, zip code, telephone number, and valid payment method information.
Should automatic billing fail to occur for any reason, Scientific Industries, Inc. will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.
Scientific Industries, Inc., in its sole discretion and at any time, may modify the Subscription fees. Any Subscription fee change will become effective at the end of the then-current Subscription period.
The Company will provide You with reasonable prior notice of any change in Subscription fees to give You an opportunity to terminate Your Subscription before such change becomes effective.
Your continued use of the Subscription Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.
Except when required by law, paid Subscription fees are non-refundable.
Certain refund requests for Subscriptions may be considered by Scientific Industries, Inc. on a case-by-case basis and granted at the sole discretion of Scientific Industries, Inc.
Scientific Industries, Inc. may, at its sole discretion, offer a Subscription with a Free Trial for a limited period of time.
You may be required to enter your billing information in order to sign up for the Free Trial.
If You do enter Your billing information when signing up for a Free Trial, you will not be charged by Scientific Industries, Inc. until the Free Trial has expired. On the last day of the Free Trial period, unless you cancelled your Subscription, you will be automatically charged the applicable Subscription fees for the type of Subscription you have selected.
At any time and without notice, Scientific Industries, Inc. reserves the right to (i) modify the terms and conditions of the Free Trial offer, or (ii) cancel such Free Trial offer.
Depending on your Subscription plan, you may be eligible to receive a loaner VIVID pill counter. A loaner can be requested only if a resolution or a fix cannot be performed remotely, and it is determined that your VIVID pill counter must be sent in for service or repair. To determine loaner eligibility, you must open a support ticket and allow Scientific Industries, Inc. technical support representatives to access your VIVID remotely and troubleshoot. The loaner may be used or refurbished with similar features and functionality. You may use the loaner only while your VIVID pill counter undergoes service and repair. Once your VIVID pill counter is returned to you, the loaner must be sent back to Scientific Industries, Inc. within 3 business days. You are responsible for shipping and handling charges. Prior to receiving your loaner, you will be required to sign a loaner agreement.
Depending on your Subscription plan, you may be eligible to receive a free tray replacement. A tray replacement can be requested only if your current tray is damaged, broken, or deemed unusable by Scientific Industries, Inc. technical support representatives. You are eligible to receive one free tray per 12-month subscription period. To determine tray replacement eligibility, you may be asked to open a support ticket and provide photos showing the damage to your existing tray. You are responsible for shipping and handling charges of your tray replacement.
Extended warranty coverage
Subscription plans with extended warranty coverage are available only for VIVID pill counters less than 5 years old.
When subscribed to a plan with extended coverage, your VIVID pill counter will be warranted against defects in material and workmanship under normal use and service. This limited warranty will not apply if, upon inspection, it is found that the product was tampered with, misused, abused, mishandled, placed in an improper environment, improperly installed or modified, used for a purpose other than that for which it was designed, or repaired by unauthorized personnel. The Company’s liability under this warranty is limited to furnishing labor and parts necessary to remedy the defect covered by this warranty and restore the product to normal operating condition. Purchasers may be charged a minimum repair fee for in-warranty products returned for repair if those products are determined to be problem-free. To make a claim under this limited warranty, you must first obtain an RMA number from the Company and return the product carefully packed, in its original packaging, shipping prepaid, with the RMA number written on the return package.
EXCEPT FOR THE LIMITED WARRANTY PROVIDED HEREIN, ALL OTHER WARRANTIES, EXPRESS AND IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE DISCLAIMED. In all events, consequential, incidental, special and other damages are excluded and the Company shall have no liability beyond the repair or replace limited warranty provided above.
